General conditions for purchase and sales through www.mijelstore.com (“General Conditions”)
These General Terms and Conditions govern the order, manner and conditions for buying and selling through www.mijelstore.com – an online store (also called MIJEL STORE), owned by “MIJEL EOOD”. These general terms and conditions constitute a contract of sale between MIJEL STORE and the Customer. MIJEL STORE provides the Customer with the opportunity to purchase the goods offered through the online store by submitting a request and paying the relevant sales price, subject to the Customer’s compliance with these General Terms and Conditions. The customer can make valid requests to purchase the goods offered through the online store only after registration and expressing agreement with these General Terms and Conditions, by which he is considered bound by the clauses of the General Terms and Conditions and undertakes to comply with them. MIJEL STORE reserves the right to change these General Terms and Conditions at any time, promptly publishing these changes on its website www.mijelstore.com together with a notice of the changes. In the case of changes to these General Terms and Conditions, the Customer may declare that he rejects the changes by sending a statement of the rejection of the changes to the email address firstname.lastname@example.org. Upon receipt of the express statement of rejection, the sales contract is deemed to be terminated. The changes in the General Terms and Conditions do not affect the relationship between the Customer and MIJEL STORE, which arose in connection with a valid request for the purchase of goods submitted before the changes. I. General provisions
For the purposes of these General Terms and Conditions, the listed concepts are used with the following meaning:
“MIZHEL EOOD” is a commercial company registered in the Commercial Register at the Registration Agency, with EIC: BG202848281, with headquarters and management address: BURGAS JK. ZORNITSA K-S PERLA BL. 1-2 GROUND FLOOR, Bulgaria, offering goods for sale through the online store www.mijelstore.com and through the MIJEL STORE store.
www.mijelstore.com is a website/portal for online buying and selling of goods/articles and services provided through MIJEL STORE online store for boutique clothes and accessories.
Each of the listed items is described with its main characteristics and selling price.
“Customer” means a natural or legal person who has registered a customer profile at www.mijelstore.com and has agreed to these General Terms and Conditions. By submitting an order/request, the Customer-individual declares and confirms that he is 18 (eighteen) years old. MIJEL STORE reserves the right to refuse an order in case of doubts about the completion of 18 (eighteen) years by the Customer.
“Customer Profile” means information about the Customer (name, surname/trading company, address, telephone, e-mail address, EIC/BULSTAT, etc.), provided by the latter during his registration and stored by MIJEL STORE for service purposes of orders and services provided by MIJEL STORE. The customer profile is accessible by entering a username and password and enables the customer to view and edit the data entered during registration, to access information on all his requests to purchase goods through www.mijelstore.com, to change the password for access, to subscribe/unsubscribe, respectively, to receive the MIJEL STORE newsletter.
II. Purchase orders/requests
In order to obtain the right to make valid purchase requests for the items offered through www.mijelstore.com, the Customer must register (by filling in a registration form) and declare his agreement with these General Terms and Conditions:
Registration – The customer provides MIJEL STORE with the following information for the purposes of registration: name, surname, telephone, e-mail address, address. The customer guarantees that the data he provides when filling out the registration form is true, complete and accurate. In the event that the Customer provides incorrect and/or out-of-date data, MIJEL STORE has the right to immediately and without notice suspend the maintenance of the Customer’s registration and access to his customer profile. The customer is fully responsible for the protection of his password, as well as for all actions carried out by him or a third party by using it.
Agreeing to the General Terms and Conditions – By ticking the box “I have read the general terms and conditions and agree to them.” and pressing the virtual button “Payment”, the Customer makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, declaring that he is familiar with these General Terms and Conditions, accepts them and undertakes to comply with them.
MIJEL STORE immediately confirms receipt of the statement of agreement with these general terms and conditions by sending a message to the Customer’s e-mail, which contains MIJEL STORE data and the text (electronic reference to the text) of these General Terms and Conditions.
Each purchase request from the Customer through www.mijelstore.com, based on these General Terms and Conditions, is submitted and carried out in fulfillment of the sales contract between the parties. In the case of a dispute whose will is to be bound by the text of these General Terms and Conditions, the person who paid the price of the goods requested for purchase is considered a party to the contract.
Submit an order/purchase request
An order/Purchase request is submitted by the Customer and the latter performs the following actions in sequence:
1. The Customer, after entering a valid username and password in the specified places on www.mijelstore.com, presses the virtual button “Login” and gets access to the form/ the form for submitting purchase requests for the goods offered through www.mijelstore.com;
2. The customer determines the type and quantity of the goods and confirms the request (by pressing the virtual button “BUY” against the relevant goods);
3. The customer enters information about the delivery address;
4. The customer chooses the payment method;
5. The customer agrees to the general conditions;
6. The request to purchase a product through www.mijelstore.com is considered to have been made after pressing the “Pay” button.
If an incomplete, incorrect or wrong address and/or telephone number is specified when submitting the order/request, it is considered invalid and MIJEL STORE is not obligated to fulfill it.
Acceptance of the order/request
The purchase request is accepted by MIJEL STORE by sending a message to the Customer’s e-mail address, with the following content: name, management address, e-mail address and correspondence data of MIJEL STORE, as well as the text (electronic reference to the text ) of these General Terms and Conditions, information on the main characteristics of the requested goods, its selling price, the value of postal or transport costs not included in the selling price and related to its delivery, the payment method chosen by the Customer, the specified invoice data and delivery address .
The request becomes effective between the parties after checking the availability of the goods requested for purchase and after confirming its validity on the contact phone number specified by the Customer or by sending a message to the Customer’s e-mail address.
The goods requested for purchase are delivered to the delivery address indicated by the Customer within the following terms:
– no later than 20 (twenty) working days – for the territory of the country.
MIJEL STORE does not guarantee the availability of ordered items. If it is impossible to fulfill its obligations, due to the fact that it does not have the goods requested for purchase in stock and the impossibility of delivery by its suppliers, MIJEL STORE within 24 (twenty-four) hours after receiving the purchase request, notifies the Customer of the depletion of the goods by calling the phone number specified during registration or by sending a message to the e-mail address specified by the Customer. MIJEL STORE will refund the value of the ordered item(s) or change the order at the Customer’s request.
The goods are delivered appropriately packed, according to their type and the transport for delivery.
The goods are handed over to the Customer or to a third party, who accepts and confirms receipt of the same on behalf of the Customer by signing the documents accompanying the goods. In the event that the Customer is not found within the delivery period at the address specified by him or access and conditions for delivery of the goods are not provided within this period, MIJEL STORE is released from its obligation to deliver the goods requested for purchase. The customer can confirm his desire to receive the goods even after the expiry of the delivery period in which he was not found at the address, bearing all the costs of the re-delivery. In this case, a new delivery period starts from the moment of the confirmation according to the previous sentence.
IV. Prices and payment methods
All prices of goods in the MIJEL STORE online store are in Bulgarian levs, including VAT. Prices do not include shipping costs.
The price and delivery costs are calculated automatically according to the delivery address entered and before pressing the virtual button “Pay” and can be paid by cash on delivery or PayPal.
With the acceptance of these General Terms and Conditions, the Customer, who is a consumer within the meaning of the Consumer Protection Act (CPLA), consents within the meaning of Article 53, Paragraph 1 of the CPLA to advance payment for the goods.
V. Customer Rights
A customer who is a consumer within the meaning of the Consumer Protection Act has the right, without owing compensation or penalty and without stating a reason, to withdraw from the concluded contract for the purchase of goods through www.mijelstore.com by returning the goods to a period of 7 (seven) working days, counted from the date of its receipt. In the event that the Customer withdraws from the concluded contract within the period of the previous sentence, he should send a statement of withdrawal from the concluded contract to MIJEL STORE and return the goods with intact integrity. The refusal statement should be sent to the address: GR. BURGAS ZHK. ZORNITSA K-S PERLA BL. 1-2 or to the e-mail address email@example.com. The customer is obliged to store the goods received by him, to ensure the preservation of its quality and its safety.
The customer has the right to refuse to receive the goods requested by him for purchase, when:
– the delivered goods clearly do not correspond to the ones ordered by him and this can be established by a simple examination of them;
– the goods were damaged during transportation.
After receiving the goods, the Customer has the right to request its return if there is a non-compliance of the goods with the agreed, which could not be established during a simple inspection of the same.
In the listed cases, the Customer may request that the goods delivered to him be replaced with a product corresponding to the purchase request submitted by him by sending a corresponding written request to MIJEL STORE.
MIJEL STORE is obliged to reimburse the Customer in full the sums paid by him no later than 15 (fifteen) working days from the date on which the Customer exercised any of his right of withdrawal.
MIJEL STORE takes care to keep the information on www.mijelstore.com always up-to-date, but does not guarantee its reliability and completeness.
MIJEL STORE does not guarantee that access to the online store will be uninterrupted, timely, secure and error-free, to the extent that this is beyond MIJEL STORE’s ability, control and will. MIJEL STORE is not responsible for not providing access to www.mijelstore.com, as well as for the non-processing or untimely processing of purchase requests, in the event of circumstances beyond its control – cases of force majeure, random events, problems in the global Internet network and in the provision of services beyond the control of MIJEL STORE.
MIJEL STORE is not responsible for the compliance of the goods offered for sale with the applicable regulatory requirements and for their qualities.
The customer is obliged to indemnify MIJEL STORE for all damages, costs and paid attorney’s fees incurred in connection with culpable failure to fulfill his obligations under these General Terms and Conditions. The customer is obliged to indemnify MIJEL STORE also for all damages caused by third parties to whom he provided his password, when using the same.
The provisions of the current legislation of the Republic of Bulgaria shall apply to matters not settled by these General Terms and Conditions.
These General Terms and Conditions are effective from 01.12.2016.
